In the first of our podcast series, Fieldfisher Director and IP expert Sheena Sheikh Brown summarises the decision of the Louboutin v Amazon joined cases (C-148/20 and C-184/21).
This decision saw the CJEU rule that Amazon and other online marketplaces can be held directly liable for counterfeit goods sold by a third party on its platform, if a user is confused by the origin of the goods advertised.
